BackstoryAI Terms and Conditions of Use

These terms and conditions (the "Terms and Conditions") govern the use of BackstoryAI (the "Site"). This Site is owned and operated by Keslin Ventures LLC (the "Operator").

Terms

By accessing the Site, accessible from https://backstoryai.com, you are agreeing to be bound by these Terms and Conditions of Use and agree that you are responsible for the agreement with any applicable local laws. If you disagree with any of these terms, you are prohibited from accessing this site. The materials contained in the Site are protected by copyright and trademark law.

Use License

Permission is granted to temporarily download one copy of the materials on the Site for transitory viewing and content creation only. This is the grant of a license, not a transfer of title, and under this license you may not:

You are responsible for Content, including for ensuring that it does not violate any applicable law or these Terms.

The Operator is under no obligation to edit or control Content that you or other users post or publish, and will not be in any way responsible or liable for Content. The Operator may, however, at any time and without prior notice, screen, remove, edit, or block any Content that in our sole judgment violates the Terms or is otherwise objectionable. For clarity, the Operator does not permit copyright-infringing activities on the Site.

Retention

Your Content may be stored on servers, databases, and other such media to provide you with services. If you do not perform at least one of the below listed actions for more than 180 days, your Content may be deleted:

The Operator is not responsible for any Content deleted as a result of retention-related actions. The Operator reserves the right to change the retention period at any time. The Operator may send a warning message via email or other communication mechanisms ahead of such deletions; however, this is purely for your convenience. These terms regarding retention will still apply even if no such warning message was sent or delivered.

Third-party Services

The Site makes use of various third-party services to provide its services. By using the Site, you agree to be bound by the terms and conditions of these third-party services. When the terms and conditions of such third-party services conflict with these Terms and Conditions, the more restrictive terms will apply. The Operator is not responsible for any damages that may arise from the use of these third-party services.

In particular, the Site makes use of OpenAI's services. You agree that your Content may be passed along to OpenAI when you use the Site. Their terms of service are available at https://openai.com/policies/terms-of-use.

Accounts

When you create an account on the Site, you agree to the following:

  1. You are solely responsible for your account and the security thereof, including passwords and any sensitive information; and
  2. All personal information you provide to us through your account is accurate, current, and truthful and you will update such information if it changes.

The Operator reserves the right to suspend or terminate your account if you are using the Site illegally or if you violate these Terms and Conditions.

Sale of Services

Various services are offered for sale on the Site. Particularly, Content Generation. Services are billed using prepaid credits ("Tokens"). Tokens are purchased in advance and are non-refundable. Tokens are valid for at least 1 year from the date of purchase. The Operator reserves the right to change the price of Tokens at any time. The Operator reserves the right to change the price of services at any time. The Operator reserves the right to change the services offered at any time.

You may receive complimentary Tokens from time to time. For example, when initially opening your account. Tokens may also be earned when completing various actions such as watching an advertisement or performing an action on the Site. Additional Tokens may be purchased on the Site. Purchases are managed through our payment processor, Stripe. Purchase of Tokens is governed by Stripe's Terms of Service: https://stripe.com/legal/payment-terms.

Disclaimer

All the materials on the Site are provided "as is". The Operator makes no warranties, may it be expressed or implied, therefore negates all other warranties. Furthermore, the Operator does not make any representations concerning the accuracy or reliability of the use of the materials on the Site or otherwise relating to such materials or any sites linked to the Site.

Limitations

The Operator or its suppliers will not be held accountable for any damages that will arise with the use or inability to use the materials on the Site, even if the Operator or an authorized representative of the Site has been notified, orally or written, of the possibility of such damage. Some jurisdictions do not allow limitations on implied warranties or limitations of liability for incidental damages, and, as such, these limitations may not apply to you.

The Operator and its directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities, or expenses including legal fees from the use of the Site.
